Acceptable Use Policy

This Acceptable Use Policy (the "AUP") describes activities and content that are prohibited on the CreatorStore platform. It supplements and is incorporated into the Terms of Service between you and CreatorStore Labs LLC ("CreatorStore," "we," "us"). By using the Service, you agree to comply with this AUP.
This AUP applies to all users of the Service, including Creators, Customers, visitors, and any content, communications, or activity carried out through the Service. CreatorStore reserves the right to update this AUP from time to time; the current version is always available at this URL.
1. Prohibited Content
You may not upload, sell, distribute, transmit, host, or otherwise make available through the Service any content that falls into any of the following categories.
a. Illegal Content. Content that is illegal to distribute, possess, or promote in the United States, the European Union, the United Kingdom, or any other jurisdiction where the content is offered or accessible, including content that violates export controls or sanctions laws.
b. Child Sexual Abuse Material (CSAM) and Related. Any content depicting, sexualizing, or exploiting minors. This includes CSAM as defined by U.S. federal law, EU Directive 2011/93/EU, and comparable laws worldwide; any content that could be construed as sexualizing individuals under the age of eighteen (18); AI-generated content of the same nature; and any content that facilitates the grooming, exploitation, trafficking, or endangerment of minors. Violations will be reported to the U.S. National Center for Missing & Exploited Children (NCMEC) and appropriate authorities in other jurisdictions, and will result in immediate account termination.
c. Adult, Sexually Explicit, or Pornographic Content. Nudity, sexually explicit content, or pornography of any kind, including AI-generated content of the same nature. This applies whether the content is intended to be sold, shown for free, embedded, or used as marketing material. CreatorStore does not verify user identity or age; adult content is prohibited platform-wide.
d. Non-Consensual Intimate Imagery, Deepfakes, and Impersonation. Content depicting a real, identifiable person in intimate, sexual, defamatory, or misleading contexts without that person's verifiable consent, including so-called deepfakes; content used to impersonate any individual, brand, or organization; synthetic voice, likeness, or biometric data of any person without express written and revocable consent.
e. Content That Infringes Intellectual Property. Content that infringes copyright, trademark, patent, trade secret, publicity, or moral rights of any third party. Selling copies of protected works you do not own or have not been licensed to distribute is prohibited. Reference our DMCA and illegal content reporting process in Section 7A of the Terms of Service.
f. Hateful, Discriminatory, or Violent Content. Content that promotes, incites, or glorifies hatred, discrimination, harassment, or violence against individuals or groups on the basis of race, ethnicity, national origin, caste, religion, gender identity, sexual orientation, disability, age, veteran status, or serious medical condition. Content that promotes, glorifies, or supports terrorism, extremist violence, mass shootings, or similar acts. Content constituting harassment, stalking, threats, doxing, or targeted intimidation.
g. Defamation and Privacy Violations. Content that defames identifiable individuals or entities; content that unlawfully discloses another person's private information, medical records, financial records, or other sensitive information without consent.
h. Weapons and Related Products. Firearms, firearm parts and accessories, ammunition, explosives, tactical gear intended for military or paramilitary use, 3D-printable weapon files, and instructions for manufacturing weapons.
i. Regulated Substances and Products. Illegal drugs and controlled substances; drug paraphernalia; tobacco, e-cigarettes, and vaping products; alcohol; unapproved pharmaceuticals; unregistered dietary supplements or nutraceuticals making health claims; unregistered medical devices; and any product requiring a license we cannot verify.
j. Financial and Gambling Content. Multi-level marketing schemes, pyramid schemes, Ponzi schemes, "get rich quick" programs, unlicensed investment advice, cryptocurrency investment schemes not compliant with securities laws, unlicensed gambling or lottery services, and unlicensed money-transfer services.
k. Fraudulent, Deceptive, or Misleading Content. Content that misrepresents the Creator, the Creator's qualifications or endorsements, the nature or benefits of the Creator Content, or Customer testimonials; fake reviews or testimonials; content that would mislead a reasonable Customer about what they are purchasing; content designed for tax evasion, money laundering, sanctions evasion, or other financial crime.
l. Malware and Malicious Code. Viruses, worms, trojans, ransomware, spyware, keyloggers, adware, cryptominers, or any code intended to disrupt, damage, or gain unauthorized access to any device or system.
m. Content That Endangers Public Health. Medical misinformation contradicting authoritative public-health guidance in a way likely to cause harm, including unproven cancer cures, dangerous unlicensed medical procedures, or content encouraging avoidance of legitimate medical treatment.
n. Content Violating Third-Party Platform Terms. Content that would violate the terms of Stripe, Google (including Google Calendar and Google Meet), PayPal, Apple, or other third parties whose services are integrated with or facilitate the Service.
2. Prohibited Technical Activities
a. Circumvention. Attempting to bypass, disable, or interfere with security features, rate limits, geographic restrictions (including via VPN in a manner that violates our Terms), content protection, or access controls.
b. Scraping and Automated Access. Using bots, spiders, scrapers, or other automated means to access the Service, extract data, or interact with Creator content or Customers, except through documented public APIs and in compliance with their terms.
c. Reverse Engineering. Reverse engineering, decompiling, or disassembling the Service or its components, except as permitted by mandatory law.
d. Interference. Interfering with, disrupting, overloading, or degrading the Service, its infrastructure, or the experience of other users; conducting denial-of-service attacks; probing, scanning, or testing the vulnerability of the Service without prior written authorization.
e. Unauthorized Access. Attempting to gain unauthorized access to any account, computer system, or data on the Service or in the possession of CreatorStore, users, or third parties.
f. Impersonation. Creating fake, misleading, or bot-generated accounts; impersonating another user, brand, or CreatorStore employee; misrepresenting your affiliation with any person or entity.
g. Manipulation. Creating fake accounts, transactions, reviews, or engagement to manipulate rankings, referral revenue, promotional credits, chargeback ratios, or platform metrics.
3. Prohibited Commercial Activities
a. Spam and Unsolicited Communications. Sending unsolicited commercial email or messages through or in connection with the Service in violation of the U.S. CAN-SPAM Act, Canada's CASL, the EU ePrivacy Directive, the UK PECR, or comparable laws. Purchasing, renting, or scraping email lists.
b. Prohibited Business Categories. Payday lending or high-interest short-term lending; unlicensed financial advisory or investment services; escort or "companionship" services; unlicensed adoption services; get-rich-quick coaching; unregistered securities offerings; unlicensed gambling.
c. Sanctions and Export Controls. Selling to, from, or through countries, entities, or individuals subject to U.S. Treasury OFAC sanctions, EU sanctions, or comparable sanctions, or otherwise in violation of applicable export control laws.
d. Tax Evasion. Using the Service in any way designed to evade tax collection, remittance, or reporting obligations.
e. Money Laundering. Using the Service to launder proceeds of unlawful activity, structure transactions to avoid reporting thresholds, or otherwise violate anti-money-laundering laws.
f. Chargeback Fraud. Colluding with Customers to file fraudulent chargebacks or artificially inflate refund rates.
4. Special Notes on AI-Generated Content
The prohibitions above apply equally to AI-generated content, whether generated using our AI Autofill feature or any external AI tool. Where applicable law requires disclosure that content was AI-generated (including under the EU AI Act), Creators are responsible for making such disclosures on their storefronts, product pages, marketing materials, and communications with Customers.
5. Reporting Violations
To report a violation of this AUP, email [email protected] (Subject: "AUP Report" or "Illegal Content Report"). See Section 7A of the Terms of Service for the reporting mechanism and requirements. We acknowledge properly submitted reports within forty-eight (48) hours.
6. Enforcement
a. Investigation. When we become aware of a possible violation, we may investigate. We are not obligated to investigate every report and may prioritize based on severity, evidence, and legal urgency.
b. Actions. Depending on the nature and severity of a violation, actions may include warning; requiring removal or modification of content; disabling specific features; disabling storefronts or checkout links; suspending or terminating the account; withholding, offsetting, or reversing payouts; reporting to Stripe or other payment processors; reporting to law enforcement, tax authorities, or regulators; and cooperating with legal process. For CSAM, terrorism, imminent threats to safety, or comparable violations, action will be immediate and without prior notice.
c. Sole Discretion. Enforcement decisions are made in CreatorStore's sole discretion. Nothing in this AUP obligates us to take any specific enforcement action, and our failure or refusal to act on any particular report does not constitute a waiver of any right or defense.
d. No Refund on Termination for Violation. Where an account is terminated for violation of this AUP, prepaid subscription fees are non-refundable except where refund is required by mandatory consumer law.
